1. About Mothr.
Mothr. (“the Company,” “we,” “us,” or “our”) is a maternal wellness platform designed to support women through matrescence — the multi-year transformation that accompanies new motherhood. Our services include, but are not limited to, our website (hellomothr.com), newsletters, personalized wellness profiles (the “Mothr. Pulse” or “Mothr. Pulse Check”), a voicemail feature (“Call Your Mothr.”), and any other voice or digital contact channels we operate.
These Terms & Conditions (“Terms”) govern your access to and use of all Mothr. services, platforms, and communications (collectively, the “Services”). By using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. Our Privacy Policy governs how we collect, use, store, and share your information; these Terms do not expand or modify the Privacy Policy.
2. Eligibility
You must be at least 18 years of age to access or use any Mothr. Services. By using our Services, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into these Terms. The Services are primarily intended for users located in the United States. If you access the Services from outside the United States, please see Section 16 (Non-U.S. Users) below.
3. Important Disclaimer: Wellness and Education Only — Not Medical or Clinical
MOTHR. IS A WELLNESS EDUCATION AND SUPPORT PLATFORM. NOTHING WITHIN OUR SERVICES CONSTITUTES MEDICAL ADVICE, CLINICAL GUIDANCE, DIAGNOSIS, PROGNOSIS, RISK ASSESSMENT, SEVERITY RATING, OR TREATMENT RECOMMENDATION.
3.1 Nature of Our Content
All content, information, resources, guidance, and communications provided by Mothr. — including but not limited to newsletter content, the Mothr. Pulse Check, pulse-check outputs, resource suggestions, status labels or scores, community messaging, and any voice communications — are provided for reflection and educational purposes only. This content is not a substitute for professional medical advice, diagnosis, or treatment from a licensed healthcare provider. Mothr. content is not intended to screen for, detect, assess the severity of, or guide the treatment of any medical or mental health condition.
3.2 Mothr. Pulse Check Outputs Are Not Clinical
Your Mothr. Pulse Check outputs — including any scores, status labels, resource suggestions, or other personalized content — are generated to support reflection and education. They are not a clinical assessment, mental health screening tool, diagnosis, risk rating, or treatment recommendation, and they should not be used or interpreted as such. Individual outputs are generated by automated systems and are not reviewed by clinicians or Mothr. staff before you receive them. See Section 5 (AI-Generated Content) for more information.
3.3 No Professional Relationship
Your use of Mothr. Services does not create a physician-patient, therapist-client, counselor-client, fiduciary, or any other professional or clinical relationship between you and Mothr., its founders, staff, partners, contributors, or affiliated practitioners or advisors.
3.4 Advisors and Contributors
Clinical advisors, healthcare professionals, or subject-matter experts may assist Mothr. in developing general content, tools, or educational materials. However, these individuals do not review your individual inputs or outputs, do not provide individualized care or advice through Mothr., and do not create any professional relationship with you by virtue of their role with Mothr.
3.5 Consult Your Healthcare Provider
You are strongly encouraged — and expressly advised — to consult with your own qualified healthcare professionals (including but not limited to OB/GYNs, midwives, therapists, psychiatrists, pediatricians, or primary care physicians) before making any health-related decisions, including decisions related to postpartum recovery, mental health, physical wellness, infant care, or any medical condition.
Never disregard, delay, or discontinue professional medical advice based on anything you read, hear, or receive from Mothr.
3.6 Limitation on Scope
Mothr. does not prescribe, recommend, or endorse any specific medical treatment, medication, clinical intervention, or diagnostic approach. Information shared is intended to educate, inform, and support reflection — not to replace evidence-based clinical guidance provided by a licensed professional.
4. Safety Resources and Emergencies
MOTHR. IS NOT A CRISIS SERVICE, A MONITORED PLATFORM, OR AN EMERGENCY-RESPONSE SERVICE.
If you or someone you know is experiencing a medical emergency, mental health crisis, or is in immediate danger, please call 911 or go to your nearest emergency room immediately. For postpartum mental health support, you may also contact the Postpartum Support International Helpline at 1-800-944-4773.
Mothr. may display safety resources, crisis hotlines, or supportive information as part of our Services. However:
- Mothr. does not monitor your responses, inputs, voicemails, or use of the Services in real time.
- Mothr. cannot detect, assess, or respond to emergencies, expressions of distress, or safety concerns.
- Mothr. does not promise to review outputs, intervene on your behalf, or route you to emergency services.
- Mothr. is not a substitute for emergency services, crisis lines, or professional care.
Mothr. reserves the right — but is not obligated — to take steps if it becomes aware of content suggesting self-harm, harm to others, abuse, neglect, child safety concerns, or another serious risk. You should not rely on Mothr. to monitor for or respond to any such content.
5. AI-Generated Content
Mothr. uses automated tools and artificial intelligence (“AI”) to generate personalized content, including pulse-check outputs, scores, resource suggestions, and other features of the Mothr. Pulse Check. Here is what you should understand about how this works:
- AI outputs are generated automatically based on your inputs. They are not reviewed by clinicians, therapists, or Mothr. staff before you receive them.
- AI outputs may be incomplete, inaccurate, inconsistent, or not appropriate for your specific circumstances. No AI system is perfect, and outputs should not be treated as definitive.
- AI systems can reflect biases present in their training data. Outputs may not equally reflect the experiences of all users.
- You should use AI-generated content as a starting point for reflection, not as a substitute for professional guidance or your own judgment.
Please refer to our Privacy Policy for information about whether and how your inputs may be used to train or improve Mothr.’s systems or any third-party AI models.
6. Your Mothr. Pulse Check Profile
When you engage with our Services, we may create a personalized wellness profile for you, referred to as your “Mothr. Pulse Check.” This profile is informed by information you provide to us (such as your responses to our pulse-check or other intake tools) and is used to:
- Personalize the content and resources we share with you;
- Deliver Mothr.-related newsletters, communications, and updates;
- Improve the overall quality and relevance of our Services.
Your Mothr. Pulse Check data is held privately. For information about how we collect, use, share, and retain your data — including data processed by AI or third-party vendors — please review our Privacy Policy. Before using the pulse-check or receiving AI-generated results, you will be required to accept these Terms and our Privacy Policy.
7. Call Your Mothr. — Voicemail Feature
CALL YOUR MOTHR. IS A VOICEMAIL FEATURE. IT IS NOT A CRISIS LINE, A MONITORED SERVICE, OR A CONFIDENTIAL OR SECURE COMMUNICATION CHANNEL.
7.1 What Call Your Mothr. Is
Call Your Mothr. is a voicemail-based feature that allows users to leave voice messages as part of the Mothr. experience. It is intended as a reflective, wellness-adjacent tool, not a professional service or monitored support channel.
7.2 No Real-Time Monitoring or Response
Call Your Mothr. is not monitored in real time. Mothr. does not promise to listen to, respond to, or act on any voicemail you leave. You should not use this feature for urgent matters, emergencies, or time-sensitive requests. If you are in crisis, please call 911 or contact the Postpartum Support International Helpline at 1-800-944-4773.
7.3 Not Anonymous or Confidential
Voicemails left through Call Your Mothr. are not anonymous, confidential, or secure. By using this feature, you understand and agree that:
- Your voicemail may be recorded and transcribed using automated tools.
- Recordings, transcripts, and associated metadata may be reviewed by Mothr. staff and processed by third-party vendors under confidentiality obligations, except that our voice platform (currently Google Voice) operates under its own independent terms as described in our Privacy Policy.
- This feature is not a secure medical, therapy, crisis, or other professional-care channel.
- You should not share highly sensitive personal health information, information about others, or anything you consider confidential through this feature.
7.4 Consent to Recording and Processing
By using Call Your Mothr., you consent to the recording, transcription, vendor processing, and use of your voicemail as described in these Terms and our Privacy Policy. Please review our Privacy Policy for information about how voicemails, transcripts, and related metadata are retained, used, and deleted.
7.5 Communications Are Not Professional-Care Channels
None of Mothr.’s communication channels — including Call Your Mothr., email, or any other contact method — are monitored for emergencies or constitute secure medical, therapy, or crisis-care channels. Do not use these channels for urgent or sensitive matters.
8. User Submissions
When you submit information to Mothr. — through the pulse-check, Call Your Mothr., email, or any other channel — you understand and agree that:
- You are responsible for what you submit. Do not submit information that is false, harmful, or that violates the rights of any third party.
- You should not submit identifying or sensitive information about another person — such as a child, partner, or family member — unless you have the right to do so and have considered the privacy implications of sharing that information.
- You grant Mothr. only the limited rights necessary to operate, maintain, protect, and improve the Services, as described in our Privacy Policy.
- Mothr. will not use identifiable stories, testimonials, voicemails, or sensitive user experiences for marketing or external-facing purposes without your separate written consent.
- None of your communications with Mothr. are monitored for emergencies, and Mothr. is not responsible for detecting or responding to urgent or crisis situations based on information you submit.
9. Information About Minors and Third Parties
Mothr. Services are intended for adults (18 and older). However, users may submit information about their babies, children, partners, or other family members as part of their wellness experience. If you submit information about a child or other person:
- You represent that you have the right to submit that information on their behalf.
- You should not submit unnecessary identifying or sensitive information about any child or other person.
- You acknowledge that you are solely responsible for how you interpret and use any Mothr. content, outputs, or resources as they relate to a child or other person.
- Mothr.’s outputs are not assessments of or recommendations for any child or third party. They reflect your inputs and are intended to support your own reflection, not to evaluate or advise on another person’s wellbeing.
10. Communications & Email
By providing your email address and engaging with our Services, you consent to receiving Mothr.-related communications, including our newsletter, wellness updates, and other platform content. You may opt out at any time by clicking “Unsubscribe” in any email or by contacting us at contact@hellomothr.com.
11. Data Collection, Use & Privacy
Our Privacy Policy governs how Mothr. collects, uses, stores, shares, and retains your personal information, including wellness and health-adjacent data, voice data, AI-processed data, and data submitted about third parties. Please review our Privacy Policy carefully before using the Services. By using the Services, you agree to the practices described in our Privacy Policy.
This section provides a brief summary only. In the event of any conflict between these Terms and the Privacy Policy, the Privacy Policy controls with respect to data practices.
11.1 What We Collect
When you use Mothr. Services, we may collect personal information you provide directly to us, including your name, email address, responses to pulse-check questions, voice messages, and any other information you voluntarily submit. We may also collect non-personal technical data (such as browser type, device information, or usage patterns) through standard web technologies.
11.2 How We Use Your Information
We use the information you provide to create and maintain your Mothr. Pulse Check profile; send you Mothr.-related content, resources, and communications; improve and develop our Services; and conduct internal research and analytics on an aggregated, de-identified basis (as defined in our Privacy Policy). 11.3 We Do Not Sell Your Data
Mothr. does not sell, rent, or license your personal information to third parties for their own commercial purposes. We may share data with service providers who assist us in operating our platform, under strict confidentiality obligations, and as required by applicable law. 11.4 Data Security

- Mothr. does not recommend, rank, endorse, refer, or match users to specific providers or services.
- Mothr. does not supervise, oversee, or assume responsibility for the services provided by any third party.
- Any dealings you have with third parties are solely between you and that third party. Mothr. is not a party to, and is not responsible for, any transaction, relationship, or outcome arising from your use of third-party resources.
- You are responsible for independently evaluating any third-party provider or resource before using their services.
If any sponsored listings, paid placements, affiliate relationships, or other financial arrangements exist in connection with any third-party resource or directory, Mothr. will disclose those relationships as required by applicable law. All content, materials, trademarks (including but not limited to “Mothr.” and “6 Years, Not 6 Weeks”), trade dress, logos, written content, design elements, and intellectual property available through the Services are the exclusive property of Mothr. and are protected by applicable intellectual property laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any Mothr. content without our express prior written consent.
14. User Conduct
By accessing our Services, you agree that you will not:
- Use the Services for any unlawful purpose or in violation of these Terms;
- Impersonate Mothr. or any person or entity;
- Attempt to gain unauthorized access to any part of our platform or systems;
- Upload or transmit any harmful, offensive, or disruptive content;
- Use the Services in any way that could damage, disable, or impair our platform or interfere with other users’ use of the Services;
- Scrape, crawl, or otherwise collect data from our Services without express written permission.
15. Disclaimers of Warranties
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY.
Without limiting the foregoing, Mothr. does not warrant or guarantee that:
- The Services will be uninterrupted, timely, secure, or error-free;
- The information, content, or AI-generated outputs provided through the Services are accurate, complete, current, or appropriate for your specific circumstances;
- The Services will meet your specific needs or expectations;
- Use of the Services will improve your wellbeing or mental health, or lead to access to care;
- Any resource, provider listing, or suggested next step is suitable, available, or appropriate for your situation;
- AI-generated outputs will be free of inaccuracies, inconsistencies, or biases;
- Any particular feature or functionality of the Services will remain available.
Your use of the Services is entirely at your own risk. Mothr. is not responsible for any decisions you make based on information accessed through our Services.
16. Non-U.S. Users
Mothr.’s content, resources, directories, and crisis contacts are primarily oriented toward users in the United States. If you access the Services from outside the United States:
- You are responsible for complying with all applicable local laws and regulations.
- Mothr. does not represent that the Services are lawful, appropriate, or available in every country or jurisdiction.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MOTHR., ITS FOUNDERS, OFFICERS, EMPLOYEES, CONTRACTORS, PARTNERS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF REVENUE, PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, OUR SERVICES.
In no event shall Mothr.’s total aggregate liability to you for any claims arising out of or relating to these Terms or the Services exceed the greater of (a) the total amount you have paid to Mothr. in the twelve (12) months preceding the claim, or (b) one hundred U.S. dollars ($100.00).
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.
18. Indemnification
You agree to defend, indemnify, and hold harmless Mothr., its founders, officers, directors, employees, contractors, agents, partners, and affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to:
- Your use of or access to the Services;
- Your violation of these Terms;
- Your violation of any applicable law, regulation, or third-party right;
- Any content or information you submit through the Services.
19. Changes to These Terms
We reserve the right to modify, update, or replace these Terms at any time at our sole discretion. We will provide notice of material changes by updating the “Last Updated” date at the top of this document and, where appropriate, by notifying you via email or a prominent notice on our website.

20. Governing Law & Dispute Resolution
20.1 Governing Law
These Terms and any dispute arising out of or related to them or the Services shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles.
20.2 Informal Resolution
Before initiating any formal dispute process, you agree to first contact us at contact@hellomothr.com to attempt to resolve any claim informally. We will make good-faith efforts to resolve disputes within thirty (30) days of receiving written notice.
20.3 Arbitration Agreement
Except for claims that qualify for small claims court and claims for injunctive or equitable relief to protect intellectual property rights, any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved exclusively through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
By agreeing to arbitration, you and Mothr. each waive the right to a jury trial and the right to participate in a class action lawsuit or class-wide arbitration.
20.4 Venue
For any matters not subject to arbitration, you consent to exclusive jurisdiction and venue in the state and federal courts located in Albany County, New York.
21. Miscellaneous
21.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Mothr. with respect to the Services and supersede all prior or contemporaneous agreements, understandings, and communications.
21.2 Severability
If any provision of these Terms is held to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect to the maximum extent permitted by law.
21.3 Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative of Mothr.
21.4 Assignment
You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent. We may freely assign our rights and obligations under these Terms without restriction.
21.5 No Third-Party Beneficiaries
These Terms do not create any third-party beneficiary rights.
21.6 Force Majeure
Mothr. shall not be liable for any delay or failure in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, internet outages, or governmental actions.
